The Commission on Elections is confident that an impeachment case against their officials will not prosper. Comelec Chairman Andres Bautista said that they are in good faith as an impeachment proceeding will have to be initiated by Congress and the trial will be conducted by the Senate. Both Houses of Congress approved the postponement of the 2016 Barangay and Sangguniang Kabataan elections to October 2017.
The Commission was cautioned that their officials will be held liable for violating RA 9340 which stipulates that the elections should be conducted on October 31, 2016, in case the President fails to sign the law on its postponement.
Comelec Spokesperson James Jimenez said that they halted all activities pertaining to the 2016 Barangay and SK polls because of clear indications from Congress and the Senate of their postponement.
“We stopped all preparations based on clear indications of postponement from Congress and the Senate. We do not want to waste resources on something that is not going to happen,” Jimenez said.
The enrolled bill on was submitted to Malacañang on October 3 and is awaiting the signature of President Duterte.
“We hope the law becomes effective before October 31 but if it is not signed by the President within 30 days from receipt in his office, then the bill automatically becomes a law,” Jimenez added. (COMELEC)
