On orders of the Department of Labor and Employment, some 830 workers of a commissary of fast-food giant Jollibee in the Cavite-Laguna-Batangas-Rizal-Quezon (Calabarzon) region will soon become regularized.
The DOLE said its order stemmed from findings that Zenith Foods Corp. and its two service contractors hired the workers on a labor-only contracting arrangement.
Covered by the compliance order are Zenith Foods Corp. and service contractors Staff Search Asia Service Cooperative and Sikap Cleaning and Sanitation Services (https://www.dole.gov.ph/ro_polo_updates/view/1486).
Investigation showed Zenith Foods is the central commissary of Jollibee Foods Corp., which operates a food processing plant in Calamba, Laguna.
Zenith serves more than 800 Jollibee and Greenwich stores in and outside the Philippines.
DOLE also ordered Zenith Foods and Staff Search Asia Service Cooperative to pay around P1.2 million to 868 workers.
This was a refund for the illegal deduction on their wages for the annual physical/medical examination. The DOLE said the violations it found included:
– lack of substantial capital on the part of the contractors, as the employees use Zenith equipment in the performance of their outsourced services.
– Zenith exercised control and authority over the deployed workers, who work alongside and perform the same functions as regular employees.
“Both the principal and the contractors were also found out to be violating general labor standards for non-payment of workers’ statutory benefits based on the joint assessments conducted by the labor laws compliance officers (LLCOs),” DOLE said. (DOLE)
